01Introduction

Welcome to UNIFY EQ (the "App"), an audio equalizer and sound enhancement utility operated by an independent developer based in Vietnam. This Privacy Policy explains how we collect, use, store, and share information when you use the App.

UNIFY EQ is not a social network. It is an audio tool with an optional preset-sharing library where users can publish their custom equalizer settings and audio configurations for other audiophiles to discover and apply.

Minimum age requirement

UNIFY EQ requires users to be at least 16 years old to create an account and use the App, in compliance with Vietnam Decree 13/2023 and EU GDPR Article 8.

Your inbox, your rules. We send transactional emails automatically (receipts, security alerts, important policy changes — these are required for the service). We also send an optional marketing newsletter — but only if you explicitly opt in, and you can opt out anytime with one tap. We never sell your email, never share it with advertisers, and never enroll you in marketing without asking. Full details in Section 4A.

UNIFY EQ requires sign-in (Google or Facebook OAuth) and age verification (minimum 16) to enable cloud features such as preset publishing, save/subscribe actions, and cross-device sync. The following data is collected and stored on our servers (Firebase):

3.1. Account & profile data

Your email address is used for two purposes only:

We never sell your email, never share it with third-party marketers, and never enroll you in marketing automatically.

3.2. Profile content (optional, you can leave blank)

3.3. Preset-sharing content (optional, only if you publish presets)

This functionality exists solely to help audio enthusiasts discover quality presets and configurations. It is not designed for general-purpose social messaging.

3.4. Technical & usage data

We do NOT collect: phone numbers, contacts, calendar, precise location, browsing history, financial info (card numbers, bank details), health data, or audio recordings.

4AEmail Communications — Transactional & Opt-In Marketing

UNIFY EQ sends two strictly separated categories of email. Transactional emails are sent automatically because they are necessary to run your account. Marketing emails are sent only to users who have explicitly opted in — off by default.

4A.1. Transactional emails (always on — required for the service)

Legal basis: performance of contract (GDPR Art. 6(1)(b)) / necessary for service provision under Vietnam Decree 13/2023. No consent toggle — you cannot opt out of these without closing your account, because they are required for the service to function safely.

  • Subscription renewal & expiry notices (when required by app stores or local consumer law)
  • Account security alerts (new device login, password reset)
  • Account deletion confirmation
  • Critical policy or pricing changes that affect you
  • Data breach notifications (per Section 14A)
We never send (any category)
  • Third-party sponsored content or paid ads inside our emails
  • Re-engagement / "we miss you" emails
  • Behavioral tracking pixels for ad networks
  • Anything to a user who opted out
  • Anything to a user under the age of 16

4A.2. Marketing newsletter (opt-in only — off by default)

Legal basis: your explicit, freely-given consent (GDPR Art. 6(1)(a) and Art. 7; Vietnam Decree 13/2023 Art. 11; Vietnam Decree 91/2020 on combating spam). New accounts are not enrolled by default. We will ask you once, you choose, and your choice is recorded.

If you opt in, you will receive emails covering only the following six topics — nothing else:

Frequency cap: About 1–2 emails per month on average. We commit to a hard ceiling of 4 emails per calendar month for any single opted-in user. If we ever come close to this limit, we will combine topics in a single email rather than send multiple.

Every marketing email we send will:

4A.3. How to opt in

There are exactly two ways to opt in. Both require an affirmative action by you — we will never enroll you silently.

(a) During your first sign-in — right after you confirm "I am 16 or older" and tap "Continue with Google", we show a dialog titled "Stay in the loop?" listing the same six topics from Section 4A.2. You tap either "Yes, sign me up" (opt in) or "No, thanks" (opt out). The dialog is shown only once. Your choice is saved on your device and synced to your account record on our servers.

(b) Later, from Settings — you can change your mind at any time using the in-app toggle. Navigate to:

When you toggle this on, a confirmation dialog titled "You are subscribed" appears showing the same six topics. Only after you tap "Got it" do we record the opt-in.

4A.4. How to opt out

Opt-out is at least as easy as opt-in, as required by GDPR Art. 7(3). You have three equally valid channels:

  1. In-app toggle — same path as above: Community › Profile tab › ⚙ gear › Community section › "Email updates from us". Switching it off takes effect immediately on your device and is synced to our servers, typically within seconds.
  2. One-click unsubscribe link in any marketing email we send. No login required, no confirmation page that re-asks. One click and you are out.
  3. Delete your account (see Section 12). This removes all your data, including marketing consent. Your hashed email address is added to our suppression list so we never contact you again.

After opt-out: we stop sending marketing emails within 24 hours (typically instant). We will not send a "we miss you" or "are you sure?" email. We will not re-prompt the in-app dialog. Your transactional emails (receipts, security alerts) continue, because those are required for your account.

4A.5. Consent record & data subject rights

For every opt-in user we store: the choice (boolean), the channel (login dialog vs. settings toggle), and the date inferred from Firebase server metadata when the record was created or modified. You can request a copy of your consent record at any time via the channels in Section 12.

4A.6. Push notifications — never used for marketing

Push notifications are used only for activity related to your own account: someone saved or commented on your published preset, someone subscribed to your creator profile, a moderator action affecting your content, or critical security alerts. We do not use push for any marketing purpose, ever. Marketing happens exclusively through opt-in email.

You can disable activity notification categories in Community › Profile tab › ⚙ gear › Notifications, or disable all notifications via Android System Settings.

05Data Sharing & Sub-Processors

Data is stored on Google Firebase infrastructure, a processor on our behalf governed by Google's Data Processing Terms.

Public profile fields (name, avatar, bio, attribution handles, published presets, feedback messages) are visible to other users of the App. Email address, marketing-email preference, billing details, age verification records, and device ID are never public.

Trusted service providers (processors)

To deliver the service, we use a small number of trusted vendors who process data only on our behalf, under Data Processing Agreements (DPAs):

We do not share your data with anyone else — no advertisers, no data brokers, no analytics resellers, no third-party marketers.

International data transfers

Because our sub-processors are based in the United States, your data may be transferred outside your country of residence. Such transfers are protected by Standard Contractual Clauses (SCCs) approved by the European Commission for EU/EEA users and the UK International Data Transfer Addendum for UK users.

UNIFY EQ offers three Premium tiers via Google Play In-App Purchase:

All transactions are securely processed by the Google Play Store. We do NOT store your credit card or bank details.

We follow Google Play's standard refund policy. Refund requests are handled through Google Play within their refund window (typically 48 hours of purchase).

09Advertising

The free version may show ads from partner ad networks (e.g. AdMob). These networks may use anonymous identifiers to deliver relevant ads. Premium users do not see ads.

Because UNIFY EQ requires users to be 16 or older, all ad inventory is treated as adult inventory — no child-directed ads are served. These in-app ads are separate from email and push communications, and ad networks do not receive your email address from us.

10Premium Plans — Scope & Limitations

Important — please read before purchasing any Premium tier.

Premium tiers (Monthly / Yearly / Lifetime) primarily unlock offline audio features on your device. Online preset-sharing features depend on server infrastructure and are provided on a best-effort basis — not guaranteed forever or indefinitely.

Online preset-sharing features require a backend server we operate at our own cost. These services are not guaranteed for the entire duration of any subscription.

10.4. Why we have to say this

Servers, databases, and cloud bandwidth cost money every month. A one-time Lifetime payment cannot fund cloud hosting forever. By choosing any Premium tier, you acknowledge that:

You have a range of rights over your personal data. The core rights below are honored globally, regardless of region:

Right to access

Get a copy of all personal data we hold about you, including your marketing-consent record.

Right to portability

Receive your data in a machine-readable format (JSON) for transfer to another service.

Correct inaccurate or incomplete data.

Right to deletion

Have your account and associated data erased.

Right to restrict

Pause processing of your data while a dispute is resolved.

Including marketing-email consent, at any time, with no penalty.

For exercising any of the rights above — we will not degrade your service for opting out of marketing.

How to exercise any right

Visit our data rights page, or email namtruyenpro95@gmail.com with subject UNIFY EQ — Data Rights Request. We respond within 30 days (45 days for U.S. state law requests).

What is deleted on account deletion

What is retained

Requests are processed within 30 days. Most are completed within 7 business days.

Inactive account policy

To minimize the data we hold, accounts that have been inactive (no app open or sign-in) for 24 consecutive months may be flagged for deletion. Before deletion, we will send a notice to the email on file giving you 30 days to sign in and keep the account active. This is a transactional notice tied to account hygiene — it is not a marketing message and is sent regardless of your marketing-email preference. Premium subscribers (Monthly, Yearly, Lifetime) are exempt from this inactivity policy as long as their purchase remains valid.

13Age Requirement & Children's Privacy

16+

You must be 16 or older

UNIFY EQ is strictly for users aged 16 and above. Younger users cannot create an account or use the App.

Why 16?

We set the minimum age at 16 to ensure full compliance with the strictest applicable privacy laws governing minors, including:

By choosing a higher minimum than legally required in some regions, we eliminate the need for region-specific parental-consent flows and ensure consistent protection for all younger people worldwide.

How we verify age

We use multiple layered signals to enforce the minimum age requirement:

Users under 16

Account creation is blocked for users we identify as being under 16. If we discover that we have inadvertently created an account for someone under 16, we will:

Marketing emails are never sent to users under 16, even hypothetically — the opt-in dialog only appears after age confirmation, and any account discovered to be underage is suppressed before any marketing send.

How parents / guardians can report

If you believe a person under 16 has created an account on UNIFY EQ, please email namtruyenpro95@gmail.com with subject Underage Account Report. Include the account name or email if known. We will investigate within 7 business days and take action within 30 days.

No exceptions, no parental-consent workaround

To keep our compliance simple and protect young people, we do not offer a parental-consent path that would allow users under 16 to use the App. There is no way to bypass the age requirement. This is intentional — we believe a clear, bright-line rule is safer than a partial exception that could be abused.

14Security

All network traffic between the App and our servers is encrypted in transit (HTTPS/TLS 1.2+). Firebase enforces server-side validation rules to prevent unauthorized data access. Passwords are not stored — authentication is delegated entirely to Google/Facebook OAuth. We follow industry best practices, but no system can be 100% secure — users acknowledge this inherent risk.

In the event of a data breach affecting your personal information, we will:

15Disclaimer of Warranties

The App is provided "as is" without warranty of any kind. We do not guarantee uninterrupted availability of preset-sharing features or that the App will be free from errors. Listening to music at high volumes for extended periods may damage your hearing or device equipment — please use with caution.

16Changes to This Policy

We may update this Privacy Policy as the App evolves. Material changes will be announced in-app or via the Play Store listing at least 14 days before they take effect.

If a future change would expand the marketing topics in Section 4A.2 (for example, adding a new topic category), or introduce a new category of communication beyond transactional and the opt-in newsletter, we will request fresh, explicit consent from you separately. We will not silently expand the scope of how we use your email or your data.

Continued use of the App after a non-consent-requiring update constitutes acceptance of the revised policy.

18Governing Law

This Privacy Policy and our Terms of Service are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles. Any dispute arising out of or relating to this Privacy Policy that cannot be resolved informally will be submitted to the competent courts of Vietnam.

This clause does not limit any non-waivable consumer rights granted to you by mandatory local law. EU/UK/EEA users retain the right to bring claims under their local consumer protection laws and to lodge complaints with their local data protection authority. U.S. users retain the right to exercise statutory privacy rights (CCPA, CPRA, VCDPA, etc.).

19Your Agreement

When you first open the App, you are shown a welcome screen that displays this Privacy Policy and Terms in a scrollable view. You will also be asked to confirm that you are at least 16 years old. By tapping the "I Agree" button in the confirmation dialog, you acknowledge that:

You can revoke your consent at any time by deleting your account (Section 12). You can revoke marketing consent specifically — without closing your account — using the in-app toggle described in Section 4A.4.
